Background: What is Crossover?
Crossover or the Crossover Deadline is the date by which certain bills must have passed at least one chamber to remain eligible for consideration during the rest of the regular session.
The Crossover Deadline is established in the House and Senate Rules at the beginning of each session and will be the same date in each chamber’s rules. Learn more about this session’s Rules here.
But – Some Bills Are Exempt From Crossover
The Crossover Deadline rules also specify which types of bills are exempt from the Crossover Deadline, such as tax, appropriations, and elections bills.
Below are the specific exemptions.
Note: It is the House Rules that determine which Senate Bills are exempt from the House Crossover Deadline and the Senate Rules that determine which House Bills are exempt from the Senate Crossover Deadline.
House Rules for Exempt Senate Bills (Rule 31.1(e) of HR 563 – House Permanent Rules)
Under the House Rules, the following Senate Bills are exempt from the House Crossover Deadline:
Bills that would be required to be referred to the Appropriations or Finance Committee under Rule 38 of the House Rules (generally, tax and appropriations bills)
Bills providing for action on gubernatorial nominations or appointments
Bills providing for action on appointments by the General Assembly
Bills providing for amendments to the North Carolina Constitution and bills containing statutory amendments necessary to implement proposed amendments to the North Carolina Constitution
Bills establishing districts for Congress or State or local entities and addressing election laws
Bills ratifying an amendment or amendments to the Constitution of the United States
Adjournment resolutions
Senate Rules for Exempt House Bills (Rule 40.2(b) of SR 1 – Senate Permanent Rules)
Under the Senate Rules, the following House Bills are exempt from the Senate Crossover Deadline:
Bills required to be referred to the Committee on Finance or the Committee on Appropriations/Base Budget by Rule 42
Bills providing for action on gubernatorial nominations or appointments
Bills providing for action on appointments by the General Assembly
Bills providing for amendments to the North Carolina Constitution and bills containing statutory amendments necessary to implement proposed amendments to the North Carolina Constitution
Bills establishing districts for Congress or State or local entities and bills addressing election laws
Bills ratifying an amendment or amendments to the Constitution of the United States
Bills adjourning the General Assembly
